Who is in the Seventh Amendment?


The Seventh Amendment creates two groups of Class Members who are eligible to participate in the Seventh Amendment: Category One and Category Two. Whether you are in Category One or Two depends on your medical condition, which type of forms you have previously filed with the Trust, and how far the Trust has processed your claim.

On or about August 28, 2004, the Trust posted the Initial Category One Class List on their website (www.settlementdietdrugs.com) listing the DDR Numbers for everyone believed to be in Category One. If you do not know your DDR Number, please contact the Trust.

If you were not on this Initial Category One List and believed you were eligible for inclusion, you had until November 9, 2004 to submit the required documents to Wyeth, with copies to the Fund Administrator. The required documents were proof of Diet Drug use, the Relevant Echocardiogram Tape or Disk and a Green Form in which: (i) Part I has been signed by the DDR; (ii) Part II has been signed by a Board-Certified Cardiologist with Level 2 or greater training in echocardiography; and (iii) and the unaudited answers in Part II contain sufficient information on medical conditions to support a claim on Matrix Level I or Matrix Level II.

If you made the required submissions and you were determined to be an additional Category One Class Member, your DDR Number was included on the Amended and Final Category One Class List, which is available on this website by clicking here. If you were not included on the Initial Category One List and subsequently requested Wyeth to include you, and your DDR Number does not appear on the Amended and Final Category One List for inclusion, and are not included on the Amended and Final Category One Class List, you can expect a letter from Wyeth outlining the reasons you are not included.
